On June 26, 2019, NWKT partner Bains Fleming presented on cyber evidence and e-discovery issues as a part of an International Association of Defense Counsel (IADC) webinar. The webinar, Preservation, Discovery, and Presentation of Cyber Evidence was sponsored by the IADC’s Business Litigation Committee, Cyber Security, Data Privacy and Technology Committee, Intellectual Property Committee, and Trial Techniques and Tactics Committee. The webinar discussed the rules and requirements regarding preservation of cyber evidence. It also addressed obtaining cyber information through discovery, evidentiary issues such as authentication and chain of custody. Finally, the panel addressed the effective presentation of cyber evidence at trial. Fleming was joined by panelist Jeff Golub of Beck Redden in Houston, TX, Paige Hunt Wojcik of Lighthouse eDiscovery, Seattle, WA, and Sandra Wunderlich of Tucker Ellis LLP, St. Louis, MO.
